Here at Casa Tara Hotel and Wellness Retreat in Baja California, we are following the security protocols to face this outbreak that has had such an unprecedented impact on the lives of many people as well as on the world economy. This situation is testing us all today but one thing that is for sure is that we will overcome and succeed.
BELOW ARE OUR SAFETY PROTOCOLS AND RELEVANT INFORMATION:
Casa Tara se ha esforzado siempre por crear la mejor experiencia para nuestros huéspedes. Ahora, más que nunca, nos tomamos esta consigna muy en serio con la Promesa de Limpieza de Casa Tara.
Nuestra promesa es poner nuestra pasión y energía en aumentar notablemente los estándares de limpieza en nuestro hotel, para el bienestar de nuestros huéspedes, colegas y comunidades.
Para cumplir con esta promesa todos los días, nuestro gerente de hotel liderará un programa de seguridad, responsable de la capacitación, implementación y cumplimiento del mismo. Además, estamos monitoreando de cerca las recomendaciones de las autoridades federales y estatales asi como de turismo con respecto a COVID-19, y continuaremos siguiendo sus pautas.
La promesa de Limpieza de Casa Tara, visible en todas las áreas públicas para huéspedes y también en las zonas de trabajo detrás del escenario y descanso de nuestro staff , es nuestra forma de externar cuánto nos preocupamos por tu seguridad.
- El equipaje será completamente desinfectado.
- Estaciones de sanitización para manos, estarán disponibles a la entrada y dentro de nuestras instalaciones.
- Las superficies y objetos de alto contacto, como los bolígrafos, se desinfectarán con frecuencia.
- Estación de sanitización para manos, estará disponible.

- Servicios de comida y bebida para llevar estarán disponibles.
- Se organizarán mesas para maximizar el espacio entre ellas mientras se acomodan los niveles de ocupación aprobados y se promoverá el distanciamiento físico.
- Se ofrecerán menús digitales y WiFi de cortesía para que los huéspedes puedan verlos en sus dispositivos personales como alternativa a los menús físicos (que también estarán disponibles).

La disponibilidad de los shalas de yoga, piscina, recreación y playas, serán determinadas por las autoridades gubernamentales locales y estatales; puede cambiar en cualquier momento. El hotel supervisará estos lineamientos. Si estas áreas se abren para su operación y son asequibles por la administración del hotel, entonces, se aplicarán todos los procedimientos descritos en Recepción y Áreas Públicas, y Restaurant & Bar.

For the wellbeing of our guests, colleagues, and communities, our promise is to put our passion and energy into notably increasing the standards of cleanliness at our hotel.
To deliver on this promise every day, our hotel Manager will lead a Safety Program responsible for training, implementation, and compliance. In addition, we’re closely monitoring the authorities and tourism recommendations regarding COVID-19 and will continue to follow their guidelines.
Casa Tara’s Promise of Cleanliness, visible throughout public guest areas and also in backstage and staff working zones, is our outward way of saying how much we care about your safety.
- Luggage will be entirely disinfected.
- Hand sanitation stations will be available at the entrance and throughout premises.
- High-touch surfaces and items such as pens will be disinfected frequently.
- Hand sanitation station will be available.
- Furniture layout in these spaces will promote proper physical distancing.
- High-touch surfaces and items will be disinfected frequently, including but not limited to counters, door handles, restroom faucets, and handrails.
- Biodegradable, one-time-use paper towels will be available in restrooms, with wastebaskets close to doors for protected door handling and discard.
- Hand sanitation stations will be available.
- All chemicals, cleaning products, PPE, and equipment used must be hospital-grade and proven to prevent the spread of contamination, and/or disinfect and kill viruses, bacteria, and diseases.
- When possible, a minimum of 24 hours will pass between new guests staying in guest rooms.
- To-go food and beverage services will be available.
- Tables will be arranged to maximize space between them while accommodating approved occupancy levels and promoting physical distancing.
- Digital menus and complimentary WiFi will be offered for guests to view on their personal devices as an alternative to physical menus (which will also be available).
- Colleagues will frequently change gloves.
- Biodegradable, one-time-use paper napkins will be made available.
- Physical menus and pens will be disinfected frequently.
- Hand sanitation stations will be available.
Availability of the yoga shalas, pool, and recreation areas such as beaches will be determined by local and state governmental authorities and can change at any time. The hotel will monitor these guidelines. Should these areas be opened for operation and are under the management of the hotel, all procedures outlined in reception and public areas, and restaurant and bar will apply.
All hotel colleagues will be required to wear Casa Tara-compliant PPE (i.e. face coverings and gloves) as part of their uniform while at the hotel and in the course of executing their duties. All hotel colleagues will receive increased comprehensive safety, health, and hygiene training.
Given the health and safety risks posed by COVID-19, we ask all guests to review their local authorities’ travel guidance and health advisories. Cancellations, Payments & Liability:
LIABILITY RELEASE FORM, BOOKING TERMS AND CONDITIONS & ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19

YOUR PAYMENT WILL CONFIRM ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Casa Tara Hotel and Wellness retreat has put in place preventative measures to reduce the spread of COVID-19; however, the hotel/retreat cannot guarantee that you or your relatives/group will not become infected with COVID-19. Further, attending the Hotel-Retreat could increase your risk and your relative’s/group’s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my relatives/group and myself may be exposed to or infected by COVID-19 by attending the hotel-retreat and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Hotel-Retreat may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Hotel-Retreat employees, volunteers, and retreat participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my relatives/group or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my relatives/group may experience or incur in connection with our attendance to the Hotel-retreat or participation in a retreat program (“Claims”). On my behalf, and on behalf of my relatives/group, I hereby release, covenant not to sue, discharge, and hold harmless to Casa Tara Hotel and Wellness retreat, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Hotel-retreat, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Hotel-retreat program.
At CASA TARA HOTEL & WELLNESS RETREAT space is limited and competitive. ALL PAYMENTS AND DEPOSITS ARE NON-REFUNDABLE. There are no refunds or partial refunds given for early checkouts from the retreat. There are ABSOLUTELY no refunds given for reasons pertaining to kiteboarding conditions or weather conditions. There are ABSOLUTELY no refunds given for reasons pertaining to a global, national, or provincial political situation that does not directly pose a security threat to the safe operations of the tour in the region. We reserve the right to sell your reservation, if you are not paid in full 30 days prior to departure. For your protection, travel insurance is advisable.
All payments are nonrefundable. For your protection, travel insurance is advisable. Full payment is required no later than 30 days before the first day of your reservation. You may change names or sell a reservation up to 30 days before the first day of your reservation. We reserve the right to sell your reservation, if you are not paid in full 90 days before your trip. Reservations made within 30 days of the trip generally require full payment at time of booking. Deposits for grandfathered reservations are due 60 days after this year's trip. If deposits or full payments are not received on time the reservation and deposit are forfeited. No refunds will be given. Any past due payments may incur a $100 late fee per reservation. We reserve the right to decline any reservation.
We reserve the right to refuse a family or medical emergency request. As a courtesy we may sometimes move a reservation to select days the following July-September period. We only move trips to selected days in July-September time lapse. We will never move an emergency cancellation to the same date of the following year. An additional fee is generally required to change the date. The payment for the change is due by the date of the originally scheduled trip. If no payment is received all payments are lost. For your protection, travel insurance is advisable.
A paid reservation constitutes an agreement between you and Casa Tara Hotel & Wellness Retreat. From this time forward, you agree to comply with all requests from Casa Tara Hotel & Wellness Retreat staff to ensure the safe operation. Any act that jeopardizes the happiness or safety of other guests staying at Casa Tara Hotel & Wellness Retreat may result in your removal from all Casa Tara Hotel & Wellness Retreat facilities and all beaches and surrounding areas used by the retreat. Casa Tara Hotel & Wellness Retreat reserves the right to remove any client for the following reasons; theft, vandalism, lewd acts, sexual misconduct, excessive drug or alcohol use, violent or combative behavior, and any act deemed inappropriate by Casa Tara Hotel & Wellness Retreat. No refunds will be given upon removal or thereafter.
Smoking is not permitted in any room or indoor area. Fines of up to $100 USD will apply for smoking in non-permitted areas of Casa Tara Hotel & Wellness Retreat for cleaning and damages.
You fully understand that staying as a retreat guest sharing a hotel room with another person or having a guest in your lodging facility or hotel room involves risks and dangers including physical harm and property damage. YOU FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND RESPONSIBILITY FOR ALL LIABILITY, LOSSES, COSTS, CLAIMS, OR DAMAGES incurred as a result of accepting or providing accommodation. Casa Tara Hotel & Wellness Retreat recommends that you always exercise due diligence and care when deciding whether to stay with a host or accept a guest.
You are solely responsible for all of your communications and interactions with other participants of the group, including, but not limited to, any hosts or guests. You agree to take reasonable precautions in all communications and interactions with other guests of the group , particularly if you communicate in your own terms regardless of whether such meetings are organized by Casa Tara Hotel & Wellness Retreat.
YOU UNDERSTAND AND AGREE that Casa Tara Hotel & Wellness Retreat is not responsible for the errors, omissions, acts, or failures to act of any third parties providing or seeking hospitality services or shared retreat accommodations. By using the Casa Tara Hotel & Wellness Retreat website or forum, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of any third party will be limited to a claim against the particular party who caused you harm. You agree not to attempt to impose liability on or seek any legal remedy from Casa Tara wellness retreat with respect to such actions or omissions.
You are aware that surfing, kiteboarding, fishing, high impact workout and or the operation of any watercraft will expose you to minor or serious risks of injury and waiver of rights. You accept and assume all risks, known or unknown, listed or unlisted, to which you may be exposed, or that may result from your voluntary decision to participate in the activities related thereto, both now and in the future, regardless of cause. You fully understand and acknowledge that outdoor recreational activities have: (a) inherent risks, dangers and hazards and such exist in my use of Casa Tara Hotel & Wellness Retreat activities; (b) my participation in such activities and/or use of such equipment may result in injury or illness including, but not limited to bodily injury, disability or death; (c) these risks and damages may be caused by the negligence of the owners, employees, officers, volunteers or agents of Casa Tara Hotel & Wellness Retreat; the negligence of the participants, the negligence of others, accidents, the forces of nature and dangers that correspond to recreational activities and/or equipment. You hereby assume all risks and dangers and all responsibility for any losses and/or damages whether caused in whole or in part by the negligence or other conduct of the owners, agents, officers, volunteers or employees of Casa Tara Hotel & Wellness Retreat. On behalf of yourself, your personal representatives and heirs, you hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify Casa Tara Hotel & Wellness Retreat and its owners, agents, officers, volunteers and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of your own or Casa Tara Hotel & Wellness Retreat equipment, water craft, motor vehicles or what may arise out of use of any other activities participated in at Casa Tara Hotel & Wellness Retreat. You specifically understand that you are releasing, discharging and waiving any claim or actions that may happen presently or in the future for any negligent acts or other conduct by the owner, agents, officers, volunteers or employees of Casa Tara Hotel & Wellness Retreat. Should any part of this contract be found to be invalid it shall not affect any other provisions in the contract.
THE ADULT ACKNOWLEDGES, UNDERSTANDS AND AGREES THAT THIS AGREEMENT, FOR HIM/HERSELF AND, IF APPLICABLE, ON BEHALF OF MINOR, IS VOLUNTARILY ASSUMING ALL DANGERS AND RISKS, INHERENT. YOU AGREE TO EXEMPT AND RELIEVE CASA TARA WELLNESS RETREAT FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
All claims, legal and otherwise, against Casa Tara Hotel & Wellness Retreat, its officers, directors, agents, employees, affiliated companies, heirs and assignees arising under, in connection with, or incident to this BOOKING TERMS AND CONDITIONS AGREEMENT, shall be determined according to the laws of the State of Baja California Sur in México and shall be adjudicated in the Courts within the jurisdictional geographic boundaries of La Paz, Baja California Sur, México, to the exclusion of the courts of any other county, state or country. In the event that one or more of the provisions of this BOOKING TERMS AND CONDITIONS AGREEMENT, for any reason, is held by a court of competent jurisdiction to be invalid or unenforceable in any respect, such invalidity or unenforceability shall not affect any other provision within this agreement and this agreement shall be construed as if such invalid or unenforceable provision had never been contained herein. Casa Tara Hotel & Wellness Retreat shall have the right to confiscate or revoke privileges at any time. Any act that jeopardizes the happiness or safety of other guests staying at the retreat may result in removal from Casa Tara Hotel & Wellness retreat and all the surrounding areas used by the retreat not excluding the beaches and waterways used by the retreat.
